Welcome to Neon Starling Art Studio. These Terms of Service govern your access to and use of our website, online store, products, content, and related services. By visiting our website, placing an order, or interacting with Neon Starling, you agree to these Terms.

For purposes of these Terms, “Neon Starling,” “Neon Starling Art Studio,” “Neon Starling Creative Studio,” “we,” “us,” and “our” refer to Neon Starling, Llc, a Nevada Limited Liability Company. “You” and “your” refer to any visitor, customer, purchaser, or user of the site.

Please read these Terms carefully before using the site or placing an order.

1. About Neon Starling

Neon Starling is an art studio and online shop offering original handmade artwork, fine art prints, apparel, stickers, and other creative objects. Each product begins with original artwork created by the artist and may be offered as a one-of-one original work, a reproduction print, a wearable item, or a small object connected to the Neon Starling visual universe.

2. Use of the Site

You may use this site for personal, lawful, non-commercial purposes, including browsing, purchasing products, contacting us, and learning more about Neon Starling.

You agree not to:

• Use the site for unlawful, fraudulent, abusive, or misleading purposes.
• Interfere with the operation, security, or functionality of the site.
• Copy, scrape, reproduce, distribute, or commercially exploit site content without permission.
• Attempt to gain unauthorized access to the site, store systems, accounts, or payment infrastructure.
• Use Neon Starling artwork, product images, descriptions, branding, or content to train, prompt, develop, or support artificial intelligence systems without express written permission.

We reserve the right to restrict, suspend, or terminate access to the site if we believe these Terms have been violated.

3. Products and Product Information

We make reasonable efforts to describe and photograph products accurately. However, colors, scale, texture, finish, and detail may appear differently depending on your screen, device, lighting, and display settings.

Original Works

Original Works are handmade, one-of-one pieces. Variations, marks, texture, irregularities, visible handwork, and imperfections are part of the nature of original art and are not considered defects.

Unless specifically stated otherwise, the purchase of an Original Work includes the physical artwork only. It does not include copyright, reproduction rights, licensing rights, merchandising rights, or any right to create derivative works.

Prints

Prints may be produced directly or through professional print partners. Minor production variation may occur between print runs, including slight differences in color, cropping, paper, finish, or scale.

Apparel

Apparel is generally made to order through production partners. Because made-to-order apparel is produced specifically after purchase, cancellation, return, and exchange options may be limited as described in our Return and Refund Policy.

Stickers and Small Objects

Stickers, accessories, and small objects may vary slightly by batch, finish, material, or production method.

We reserve the right to update, modify, discontinue, or limit availability of any product at any time.

4. Orders and Acceptance

When you place an order, you are making an offer to purchase the selected product or products. An order confirmation means we have received your order, but it does not guarantee acceptance, availability, fulfillment, or shipment.

We reserve the right to cancel or refuse any order for any reason, including suspected fraud, payment issues, pricing errors, product unavailability, fulfillment limitations, shipping restrictions, or violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund for the cancelled item or order.

5. Pricing, Payment, and Taxes

All prices are listed in the currency shown at checkout. Prices may change at any time without notice.

Payment is due at the time of purchase. Payments are processed through third-party payment providers, including Shopify and/or other payment processors. We do not directly store your full payment card details.

You are responsible for any applicable taxes, duties, customs fees, import fees, or other charges associated with your order, unless otherwise stated at checkout.

We reserve the right to correct pricing errors, even after an order has been placed. If a pricing error affects your order, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the order.

6. Shipping and Delivery

Shipping options, estimated delivery dates, and rates are shown at checkout when available. Delivery estimates are not guarantees.

Processing time and shipping time are different. Processing time refers to the time needed to prepare, produce, package, or fulfill an order. Shipping time refers to the time the carrier takes to deliver the order after it has shipped.

Original Works may be shipped using insured USPS flat rate shipping or another appropriate carrier method. Signature confirmation may be required for certain higher-value orders at our discretion.

Made-to-order products, including apparel and certain prints, may ship directly from third-party production or fulfillment partners. Items in the same order may ship separately.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed deliveries, or lost packages caused by incorrect or incomplete address information.

If we cannot ship within the timeframe stated or reasonably expected, we may contact you with an updated estimate and, where required, give you the option to accept the delay or cancel for a refund.

7. Risk of Loss and Delivery Issues

Once an order is marked delivered by the carrier, it is considered delivered for purposes of fulfillment. If you believe your package was lost, stolen, misdelivered, or damaged, contact us as soon as possible at studio@neonstarling.com

For damaged items, please keep the item, packaging, shipping materials, and any documentation. We may require clear photos of the product, packaging, shipping label, and damage in order to review the issue, file a carrier claim, or arrange a replacement or refund where applicable.

8. Returns, Refunds, and Exchanges

Returns, refunds, replacements, and exchanges are governed by our Return and Refund Policy, which is incorporated into these Terms.

In general:

• Original Works are final sale except in cases of confirmed damage in transit.
• Made-to-order apparel may not be eligible for return or exchange unless defective, damaged, misprinted, or the wrong item was received.
• Prints may be eligible for replacement or refund if they arrive damaged, defective, or incorrect.
• Stickers and small objects may be handled through a simple, low-friction replacement or refund process depending on the issue.

Please review the Return and Refund Policy before placing an order.

9. Intellectual Property

All artwork, designs, images, product photographs, product names, written content, logos, branding, graphics, layouts, and other materials on the site are owned by Neon Starling, the artist, or applicable rights holders.

You may not copy, reproduce, modify, sell, resell, distribute, display, publish, license, create derivative works from, or commercially exploit any Neon Starling content without prior written permission.

Purchasing a product does not give you ownership of the underlying artwork, image rights, copyright, trademark rights, reproduction rights, licensing rights, merchandising rights, or derivative work rights.

You may display and enjoy the physical product you purchased. You may resell a physical original, print, garment, or object that you lawfully purchased, but you may not reproduce, scan, photograph for commercial use, manufacture, mint, license, print, distribute, or otherwise exploit the artwork or design.

10. User Content, Reviews, and Social Media

If you submit a review, comment, photo, message, tag, or other content to Neon Starling or post content publicly that tags or mentions Neon Starling, you represent that you have the right to share that content.

By submitting content directly to us or posting public content that identifies Neon Starling, you grant us a non-exclusive, royalty-free, worldwide license to view, share, repost, display, and use that content for promotional, marketing, website, and social media purposes, unless you tell us otherwise in writing.

We may choose not to publish or may remove user content at our discretion, including content that is abusive, misleading, infringing, offensive, spam-like, or inconsistent with the brand.

11. Third-Party Services and Links

Our site may use or link to third-party services, including Shopify, payment processors, shipping carriers, fulfillment partners, print providers, apparel production partners, analytics tools, email tools, and social media platforms.

We are not responsible for the content, policies, performance, errors, delays, outages, or practices of third-party services. Your use of third-party services may be subject to their own terms and privacy policies.

12. Promotions, Discounts, and Gift Cards

We may offer discounts, promotions, limited releases, bundles, or other special offers from time to time. Promotions may be changed, limited, or discontinued at any time.

Discount codes must be used at checkout and may not be applied retroactively unless we choose to do so at our discretion.

Promotions may be subject to additional terms, including expiration dates, product exclusions, order minimums, and usage limits.

13. No Warranty

The site and products are provided on an “as available” basis. To the fullest extent permitted by law, Neon Starling disclaims all warranties not expressly stated in these Terms or required by law.

We do not guarantee that the site will be uninterrupted, secure, error-free, or free of harmful components. We do not guarantee that all product descriptions, images, pricing, availability, or shipping estimates will be free from error.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

14. Limitation of Liability

To the fullest extent permitted by law, Neon Starling will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, business interruption, or reputational harm.

To the fullest extent permitted by law, our total liability for any claim related to a product, order, site use, or these Terms will not exceed the amount you paid to Neon Starling for the product or order giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Neon Starling, its owner, artist, affiliates, partners, service providers, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising from your violation of these Terms, misuse of the site, infringement of intellectual property rights, or unlawful conduct.

16. Privacy

Your use of the site is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect information.

17. Changes to the Site or These Terms

We may update, modify, suspend, or discontinue any part of the site, products, policies, or these Terms at any time.

When we update these Terms, we will revise the “Last Updated” date above. Your continued use of the site after changes are posted means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

Any dispute arising from these Terms, the site, or your purchase from Neon Starling will be handled in the state or federal courts located in Clark County, Nevada, unless applicable law requires otherwise.

19. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining sections will remain in effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies posted on the site, make up the entire agreement between you and Neon Starling regarding your use of the site and purchase of products.
